Congratulations to Stephanie McDougall for a double victory! Our client, the owner and manager of a building, faced significant exposure following a tragic incident in which a 65 year old gentleman died in the building’s swimming pool. Stephanie persuaded the Court to dismiss the case against our client, arguing that the accident was caused by an unknown medical emergency for which our client was not responsible. After plaintiffs lost a motion to reargue, they brought a second action against the building personnel for the same injury. Stephanie was successful in getting this separate action dismissed because the issue of liability was already decided in the first action. Way to go Stephanie!
