Congratulations to Steven Lavietes, Jill Laurence and Heidi Lewis for their victory in persuading the Kings County Supreme Court to dismiss the plaintiff’s lawsuit. Our client, the building owner, faced significant exposure following an incident in which the Plaintiff claimed to have fallen from a mechanical bulkhead structure located on the recreational rooftop deck of her apartment building. The plaintiff claimed that our client failed to install an adequate guard rail around the bulkhead structure and that her fall caused severe neurological injuries. Heidi successfully argued in a motion for summary judgment that our client was not responsible for the plaintiff’s fall and the judge dismissed the plaintiff’s Complaint. Way to go Steven, Jill and Heidi.
