Mr. Cohen is a partner in the Firm’s Commerical Litigation Department. He represents businesses of all sizes in a full range of civil and commercial litigation, including breach of contract, insurance coverage, product liability, construction, fraud, securities and commodities, professional liability, personal injury, premises liability, and defamation. He is experienced in all phases of litigation in state and federal trial and appellate courts, and in arbitral forums.

A skilled, efficient litigator, Mr. Cohen breaks down the issues and devises a precise path toward an optimal resolution. He gives clients his undivided attention and understands their predicaments, then solves them.

Mr. Cohen has played a major role in some of the most significant, multi-defendant litigations throughout the United States, coordinating complex legal strategy and discovery efforts. He has led critical depositions, hearings, conferences, and trials in such high-stakes, high-profile cases as September 11-related litigations, defense of asbestos actions, and residential mortgage-backed securities litigation arising from the 2007 financial crisis.

Before joining the Firm, Mr. Cohen was Counsel at Ganfer Shore Leeds & Zauderer.

  • Prosecuted an arbitration employment claim on behalf of AM Law 100 partner resulting in eight-figure settlement
  • Tried breach of contract action for construction contractor sued for allegedly failing to pay for services by a subcontractor, resulting in defense verdict and also 100% recovery on client’s counterclaim against subcontractor
  • Prosecuted to a successful eight-figure settlement of a suit on behalf of a founder of a large real estate company to obtain a founder’s stake in the company
  • Prosecuted tort actions and insurance claims arising out of the September 11 attacks against the responsible airlines and others, leading to the recovery of billions of dollars for the rebuilding of the World Trade Center
  • Obtained the dismissal of securities litigation defendant executive of multinational telecommunications company.
  • Prosecuted a declaratory judgment and breach of contract action to enforce client’s defense and indemnification rights in Eastern District of Wisconsin, resulting in damages paid to client and concession by defendant of its defense and indemnity obligations
  • Prosecuted a $300 million settlement of a derivative action involving a complex scheme by corporate insiders to transfer company assets to themselves
  • Successfully defended AM Law 100 firm in legal malpractice action involving property and real estate issues
  • Intervened in a real estate litigation on behalf of lender to successfully protect the lender’s interests
  • Defended a large midtown Manhattan hotel in a foreclosure action leading to a commercial resolution
  • Defense of and ultimate dismissal without payment of thousands of personal injury, wrongful death, and property damages actions arising out of the September 11 attacks
  • Defended asbestos-in-buildings and asbestos bodily injury claims, including acting as national coordinating counsel, taking the lead in numerous depositions, arguing motions and trying cases, resulting in the dismissal without payment of all of the asbestos-in-buildings actions and of thousands of bodily injury actions
  • Defended a multimillion-dollar ground water contamination action in United States District Court in the United States Virgin Islands, obtaining summary judgment
  • Defended a fraud and racketeering action against an executive at a financial institution in connection with a Commodity Futures Trading Commission-imposed shutdown of a hedge fund, obtaining summary judgment
  • Prosecuted defamation action and defense of counterclaims on behalf of a former member of the Russian legislature seeking refuge in the United States, arising out of a negative public relations campaign intended to drive the client out of the United States
  • Tried action against a safety eyewear manufacturer, regarding a distribution contract, resulting in damages limited to less than 1/10th of amount sought in the breach of contract and fraud action
  • Prosecuted and tried a premises liability action on behalf of a crime victim who was terrorized by an intruder inside her apartment, resulting in a multi-million dollar settlement following eight days of trial
  • Represented construction contractor client, manufacturer/distributor client, real estate developer client, law firm partners, and others on non-litigation matters, including achieving early resolution of disputes, drafting and negotiating contracts, handling insurance coverage and defense and indemnification issues, filing and discharging liens, dealing with both sides of collection matters, and providing advice on bonding, Administrative Code, and other areas
