Rod Biermann is Practice Group Head for the Employment Law Group at Dorf & Nelson LLP.

Mr. Biermann has experience representing employers and executives, partners, and professionals, in a wide variety of employment related claims and issues. He has litigated complex employment matters in Federal and State Court and in arbitrations and mediations on behalf of both companies and individuals, including claims of Discrimination; Hostile Work Environment; Retaliation; Disability; Wage and Hour Violations; Restrictive Covenant Breaches; and Employee Benefits Claims.
Mr. Biermann also has significant experience with complex employment agreements from both the employer and employee perspective, including drafting and negotiating executive level employment contracts, severance agreements, consultation agreements, and restrictive covenants.
In addition Mr. Biermann has experience conducting employment law audits to determine whether a company is in compliance with all up to date employment law mandates, and experience vigorously defending small and large corporations against New York State Department of Labor audits.
Prior to entering law school Mr. Biermann spent a number of years, in Los Angeles, as an actor in the entertainment industry, where he landed substantial roles in major studio films including Pearl Harbor, and The Adventures of Rocky and Bullwinkle, and starred/guest starred in numerous sitcoms, dramas, movies of the week, TV pilot episodes.

Mr. Biermann graduated from the University of Illinois, Champaign-Urbana, with a Bachelor of Arts Degree in Liberal Arts and Sciences and received his Juris Doctorate from City University of New York School of Law, where he was an Editor of the New York City Law Review.
He is admitted to practice law in the United States Court of Appeals, Second Circuit; United States District Court, Southern and Eastern Districts of New York; and in the State of New York.

Mr. Biermann regularly presents employment law programs to various companies, trade groups, and committees, in all areas of employment law, including Discrimination avoidance, Hostile Work Environment recognition and prevention, Retaliation prevention, the Reduction In Force process, employee termination strategies and best practices, and severance and release drafting and enforcement.
Mr. Biermann recently lectured at the New York City Bar on legal issues arising from employment terminations. The lecture was attended by over 100 in-house counsel, employment attorneys and HR professionals.
Mr. Biermann also trains corporate executives, management teams and their employees in many aspects of employment law, including discrimination awareness, wage and hour compliance, hiring and termination preparedness.
Mr. Biermann has been featured in various articles about his transition from acting to the courtroom, most significantly in the article “Take 2“, from the Westchester County Business Journal.

Mr. Biermann has significant experience as a litigator representing corporate and individual clients in complex commercial, civil rights, and real estate litigation in New York State, Federal, and Appellate Courts, and in both mediations and arbitrations. Mr. Biermann’s litigation practice focused on corporate law, civil rights and constitutional law, defamation law and real property law.

Nationwide data marketing institution’s contract claims;
Large-scale short term rental company’s consumer protection law and public nuisance claims;
School district’s due process claims;
Large scale commercial real estate development group’s real property law claims
New York City Hotel’s contract disputes.
Additionally, Mr. Biermann’s litigation strategy includes resolving client’s legal issues outside the courtroom through settlement negotiation. Mr. Biermann has settled numerous cases on behalf of both plaintiffs and defendants, in a wide range of matters, including: Settlement in a defalcation case with one of the largest brokerage and banking firms in the world, and an unprecedented settlement with the City of New York in a case of first impression dealing with the recent ban on short-term rental of residential units.
